HELP in setting up my substrate stack

Hi, I am new to this forum and would like to ask for some help.  I need to simulate this kind of substrate configuration.

Free Space
--------- Conductor  (top)
substrate (1)
-------- Ground    (top)
substrate (2)
------ Conductor   (bottom)
Substrae  (3)
-------- Ground         (bottom)

The bottom conductor, since it is embedded between two ground planes, is an embedded stripline structure, while the top cond will be a microstrip since it has air on top.

I need to have my embedded stripline structure be connected to my microstrip so I have to put a via that crosses substrates 1 and 2, and I wish to have both ground layers as ideal. From the substrate information I have above, the bottom ground can easily be declared as ideal ground.  My problem is declaring the ground (top) as an ideal ground.  

so my question is if I declare the Ground (top) as slot, will that make it ideal?  On this slot layer, can I put a circular structure around the via (since this structure is on the slot layer, this circle is nonconductive) so I can avoid shorting the via to ground?
